This website is operated by Level Up Gaming NZ. Throughout the site, the terms “we”, “us” and “our” refer to Level Up Gaming NZ.

By visiting our site and/or purchasing something from us, you agree to be bound by the following terms and conditions.

Online Store Terms

You agree not to use our products for any illegal or unauthorized purpose. You must not violate any laws in your jurisdiction when using this website.

Product Information

We strive to display product information as accurately as possible.

Pricing and Availability

Prices are subject to change without notice. We reserve the right to modify or discontinue products at any time.

If for any reason a product is not available, Level Up Gaming NZ will endeavour to notify the non-availability on this website. Level Up Gaming NZ may revise the range of products or the specifications of any product at any time, without notice to the buyer.

Cancellations

Where products are listed on this website with an incorrect price or with incorrect information, Level Up Gaming NZ reserves the right to cancel the buyers order (regardless of whether the buyer has made payment for that order). Where the buyer has already made payment for an order that is subsequently cancelled by us, we will refund the amount paid by the buyer in relation to that order.

The buyer may cancel their order any time prior to dispatch. Any such variation or cancellation of the buyer’s order shall have no effect unless accepted in writing by Level Up Gaming NZ prior to dispatch.

Prices & GST

The prices for the products on the website are stated and are payable in New Zealand dollars (NZD). 

All prices and delivery charges within New Zealand are inclusive of New Zealand Goods and Services Tax at the rate of 15%, unless otherwise specified.

Orders

We reserve the right to refuse or cancel any order for reasons including suspected fraud, pricing errors, or product availability.

Shipping

Orders will be processed and shipped according to our Shipping Policy. Delivery timeframes are estimates and may vary.

Returns and Refunds

Returns and refunds are handled in accordance with our Refund Policy.

Gift Cards

Gift cards & vouchers will not be exchanged for cash and are not subject to returns for credit or refunds. Level Up Gaming NZ will not replace a gift card that is lost or stolen after being received. Gift vouchers cannot be used to buy more gift vouchers.

Limitation of Liability

Level Up Gaming shall not be liable for any damages arising from the use of our products or website.

Changes to Terms

We reserve the right to update or modify these Terms and Conditions at any time. Changes will take effect immediately upon posting on the website.

Consumer Guarantees

The Consumer Guarantees Act 1993, Fair Trading Act 1986 and other statutes may imply warranties or conditions or impose obligations upon Level Up Gaming NZ which cannot by law be excluded or modified.  In respect of any such implied warranties, conditions or terms imposed on Level Up Gaming NZ's liability shall only apply to the minimum extent required by the relevant statute.

Risk, Damage, Loss and Force Majeure

Once the buyer's order has been delivered to the buyer (or has otherwise been delivered in accordance with the buyer’s delivery instructions), the buyer assumes full responsibility for and risk in the products.

Level Up Gaming NZ shall not be liable to the buyer for any loss or damage, directly or indirectly arising out of or in connection with any delay in delivery of the goods, or failure to perform any term of this contract where such delay or failure is outside the Level Up Gaming NZ's reasonable control.

Limitation of Liability

Level Up Gaming NZ will not be liable for any losses of any kind or any delay in supplying the goods which are caused in whole or in part by circumstances beyond its reasonable control. This limitation of liability includes, but is not limited to, costs, indirect or consequential loss, loss of contracts, loss of profits and damages caused by or arising from delays in manufacture or delivery of the goods.

Should any liability arise for Level Up Gaming NZ, such liability shall be limited to the value of the goods supplied.

Changes to our Policy

Occasionally, Level Up Gaming NZ may, at our discretion, revise or update this Policy. Once posted here, changes will take effect immediately.
